What Is Bankruptcy?

Bankruptcy is a legal process designed to help individuals and businesses who are unable to meet their financial obligations to resolve their debts. In Canada, bankruptcy is primarily governed by the Bankruptcy and Insolvency Act. Bankruptcy is typically initiated by the debtor who voluntarily files for bankruptcy, or it can be forced by creditors through a court application. The debtor surrenders their assets to a Licensed Insolvency Trustee who then liquidates the assets to maximize recovery for the creditors.
